Saorview Website Terms & Conditions

Saorview.ie is a website which provides information regarding the Saorview DTT platform, which is established, operated and maintained by Raidió Teilifís Éireann (“RTÉ”). Saorview.ie is a separate website to RTÉ’s other websites and the Saorview.ie data is held separately from all other RTÉ data.

Access to and use of the saorview.ie website (the "Saorview Site") is provided by RTÉ on the following terms.

By using the Saorview Site you agree to be bound by these Saorview Website Terms and Conditions, the Saorview Privacy Policy and the RTÉ Cookies Policy, all of which shall take effect immediately on your first use of the Saorview Site. If you do not agree to be bound by all of the following terms as well as the Saorview Privacy Policy and RTÉ Cookies Policy please do not access, use and/or contribute to the Saorview Site.

RTÉ may change these terms as well as the Saorview Privacy Policy and the RTÉ Cookies Policy from time to time and so you should check these terms regularly. Your continued use of the Saorview Site will be deemed acceptance of the updated or amended terms. If you do not agree to the changes, you should cease using the Saorview Site. If there is any conflict between these terms and specific local terms appearing elsewhere on the Saorview Site then the latter shall prevail.

You may access the Saorview Site without registering your details with us. Certain areas of the Saorview Site may be open to you if you register. If so those restricted areas may be subject to additional terms, for example, Saorview ID Terms and Conditions.

You agree to use the Saorview Site only for lawful purposes, and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of the Saorview Site. Prohibited behaviour includes but is not limited to harassing or causing distress or inconvenience to any person, soliciting minors, transmitting obscene or offensive content, or disrupting the normal flow of dialogue within the Saorview Site or anything which may affect the operability or security of the Saorview Site.

You are permitted to print and download extracts from the Saorview Site for your own use on the following basis:

(a) that no documents or related graphics on the Saorview Site are modified in any way;
(b) that no graphics on the Saorview Site are used separately from the corresponding text.

You may not copy, reproduce, republish, disassemble, decompile, reverse engineer, download, post, broadcast, transmit, frame, merge, edit, adapt, re-sell, reuse, produce summaries, make available to the public, or otherwise use the Saorview Site and/or the Saorview Site content in any way except for your own personal, non-commercial, non-business use. You also agree not to adapt, alter or create a derivative work from any Saorview Site content except for your own personal, non-commercial, non-business use. Any other use of Saorview Site content requires the prior written permission of RTÉ.

You are not permitted to use any trademark, patent, design right, database right or, copyright or any other intellectual property right of Saorview and/or RTÉ and/or any third party without the prior written consent of RTÉ or the relevant third party.

All copyright, trademarks, design rights, patents and other intellectual property rights (registered and unregistered) in and on the Saorview Site and all content (including all applications) located on the Saorview Site shall remain vested in RTÉ or its licensors (which includes other users).

The names, images and logos identifying RTÉ, Saorview, Saorview Connect, or third parties and their products and services are subject to copyright, design rights and trademarks of RTÉ, Saorview and/or third parties. Nothing contained in these terms shall be construed as conferring any licence or right to use any trademark, design right or copyright of RTÉ, Saorview, Saorview Connect or any third party.

Links to third party websites including without limitation retailers’ websites on the Saorview Site are provided solely for your convenience. If you use these links, you leave the Saorview Site. RTÉ has not reviewed all of these third party websites and does not control and is not responsible for these websites or their content or availability. RTÉ therefore does not endorse or make any representations about them, or any material found there, or any results that may be obtained from using them. If you decide to access any of the third party websites linked to the Saorview Site, RTÉ shall not be held responsible for any content, advertising, products, services or information on or available from third party websites, you do so entirely at your own risk.

If you would like to link to the Saorview Site, you may only do so on the basis that you link to, but do not replicate, the home page of the Saorview Site, and subject to the following conditions:

(a) you do not remove, distort or otherwise alter the size or appearance of the Saorview and/or Saorview Connect logos;
(b) you do not create a frame or any other browser or border environment around the Saorview Site;
(c) you do not in any way imply that RTÉ or Saorview is endorsing any products or services other than its own;
(d) you do not misrepresent your relationship with RTÉ or Saorview nor present any other false information about RTÉ or Saorview;
(e) you do not link from a website that is not owned by you;
(f) your website does not contain content that is distasteful, offensive or controversial, infringes any intellectual property rights or other rights of any other person or otherwise does not comply with all applicable laws and regulations.

RTÉ expressly reserves the right to revoke the right granted above for breach of these terms and to take any action it deems appropriate.

The Saorview Site does not provide details of pricing and stock information. Please check with retailers for the latest information on prices and the Saorview Approved and Saorview Connect products they stock. RTÉ does not accept any responsibility for the accuracy of the information provided by retailers.

Saorview Site content, including the information, names, images, pictures, logos and icons regarding or relating to RTÉ as well as to Saorview, its products and services (or to third party products and services), is provided "AS IS" and on an "AS AVAILABLE" basis. To the extent permitted by law, RTÉ excludes all representations and warranties (whether express or implied by law), including the implied warranties of merchantability, fitness for a particular purpose, non-infringement, compatibility, security and accuracy. While RTÉ tries to ensure that all content provided by RTÉ is correct at the time of publication no responsibility is accepted by or on behalf of RTÉ for any errors, omissions or inaccurate content on the Saorview Site. While RTÉ endeavours to ensure that the Saorview Site is normally available 24 hours a day, RTÉ shall not be liable if for any reason the Saorview Site is unavailable at any time or for any period and access to the Saorview Site may be suspended temporarily and without notice in case of system failure, maintenance or repair for reasons beyond RTÉ’s control.

RTÉ is not the manufacturer or seller of the digital boxes, digital TV recorders, integrated TVs and any other such products referred to on the Saorview Site ("the Products") or the provider of installation services. Before purchasing any Product or installation service, RTÉ recommends that you obtain full details on the best Product for you and information regarding installation from your retailer. If you have a satellite contract or warranty agreement for a satellite dish that you already have, we recommend you check it to make sure that you are allowed to install other equipment (such as Saorview combi product) without affecting your supplier's rights or yours.

Nothing in these terms limits or excludes RTÉ's liability for death or personal injury caused by its proven negligence, fraud, misrepresentation as to a fundamental matter or any liability which cannot be excluded or limited under applicable law. Subject to the previous sentence, RTÉ shall not be liable for any of the following losses or damage (whether such damage or losses were foreseen, foreseeable, known or otherwise): (a) loss of data; (b) loss of revenue or anticipated profits; (c) loss of business; (d) loss of opportunity; (e) loss of goodwill or injury to reputation; (f) losses suffered by third parties; or (g) any indirect, consequential, special or exemplary damages arising from the use of the Saorview Site regardless of the form of action.

RTÉ does not warrant that functions available on the Saorview Site will be uninterrupted or error free, that defects will be corrected, or that the Saorview Site or the server(s) that make it available are free of viruses or bugs. You acknowledge that it is your responsibility to implement sufficient procedures and virus checks (including anti-virus and other security checks) to satisfy your particular requirements, in particular and without limitation, for the accuracy of data input and output.

If any term is determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive and continue to be binding and enforceable.

The failure or delay of RTÉ to exercise or enforce any right in these terms does not waive RTÉ’s right to enforce that right.

These terms shall be governed by and interpreted in accordance with the laws of Ireland, and the courts of Ireland shall have exclusive jurisdiction over any disputes.

Saorview Mobile Application Terms & Conditions

Saorview is run by Raidío Teilifís Éireann (RTÉ) which operates and manages Saorview.

1. General

This document sets out the terms and conditions under which RTÉ provides the Saorview Mobile Application to your iOS (iPhone, iPad or iPod Touch) device or Android (smartphone or tablet) device. By downloading the Saorview Mobile Application from the Apple App Store or Google Play Store you agree to be bound by these Terms & Conditions and the Saorview Privacy Policy.

2. Using the Saorview Mobile Application

In order to use the Saorview Mobile Application, you must:

a. be at least 18 years old and a permanent resident in the Island of Ireland;
b. have a Wi-Fi connection or a 3G/4G mobile data connection as a minimum; and
c. download the Saorview Mobile Application from the Apple App Store or Google Play Store.

In order to use the Saorview Mobile Application with your Apple device, your Apple device must have the iOS 9.0 operating system (or higher iOS specification). If you are unsure of the operating system of your Apple device, please check in General – Settings – About.

In order to use the Saorview Mobile Application with your Android device, your Android device must be running Android v.4.1 (Jelly Bean) operating system (or higher specification). Some Android devices may not be supported; the Google Play Store will confirm whether your Android device can support the Saorview Mobile Application or not.

In order to use the Saorview Mobile Application together with a Saorview Connect device, you must:

(a)    have a Saorview Connect device (see the Saorview website at saorview.ie for details);

(b)    your mobile device must be connected to the same Wi-Fi network as your Saorview Connect set-top box; and

(c)    register for a Saorview ID and pair with your Saorview Connect device, specifically in order to manage recordings and use the remote record feature (available from mid-2018).

If you pass your Saorview Connect device onto someone else, you should do a factory reset before you pass it on.

By using the Saorview Mobile Application, you may be downloading and uploading data which may contribute towards any data limit you may have as part of your mobile phone or internet contract with your provider. Please ensure you check any such limits with your provider. Saorview is not responsible for any charges you may incur from your mobile phone or internet provider for using the Saorview Mobile Application.

The Saorview Mobile Application content is provided for non-commercial use in the Republic of Ireland only. You must not copy the content or make it available to the public or seek to authorise anyone else to do so.

The Saorview Mobile Application is made available to you free of charge. If any charges are to be introduced in the future, Saorview shall notify you in accordance with section 7 below.

3. Intellectual Property

All copyright, trademarks, design rights and other intellectual property rights in the content of the Saorview Mobile Application remains the property of RTÉ or, where applicable, the content providers (for example TV3). RTÉ grants you a limited licence to use such rights for your personal use of the Saorview Mobile Application on your device only.

4. Suspension or Restriction of use of the Saorview Mobile Application

Saorview reserves the right to suspend, change, interrupt or restrict the use of the Saorview Mobile Application for technical updates and other maintenance or operational services. Saorview also reserves the right to suspend or terminate use of the Saorview Mobile Application if (i) you have breached these Terms & Conditions or the Privacy Policy, or (ii) we suspect that you have committed or may be committing fraudulent activity against us, another organisation or another user of the Saorview Mobile Application. Saorview reserves the right to withdraw the Saorview Mobile Application at any time without notice.

5. Our Liability

While Saorview makes reasonable efforts to ensure the accuracy of the information of the content on the Saorview Mobile Application, we do not accept any liability and make no representations or warranties in relation to the accuracy or completeness of any content made available by Saorview on the Saorview Mobile Application.

Saorview shall not be liable for: (i) any incompatibility between the Saorview Mobile Application and your device’s hardware, software or any Wi-Fi or 3G/4G connection; (ii) any content on the Saorview Mobile Application provided by content providers or other third parties; or (iii) any financial losses (howsoever caused and whether direct or indirect losses) or loss or corruption of data.

While Saorview makes reasonable efforts to ensure the Saorview Mobile Application is free from errors, bugs or viruses, we do not accept any liability and make no representations or warranties in relation to any errors, bugs or viruses that may arise as a result of using the Saorview Mobile Application.

The disclaimers contained in this section 5 do not, and make no attempt to, affect your statutory rights as a consumer in the Republic of Ireland.

6. Notices

Saorview will send any notices to you via email using the email address entered when registering for your Saorview ID. It is your responsibility to ensure this email address is up to date otherwise you will not receive notices from Saorview.

7. Amendments to these Terms & Conditions

Saorview will notify you if we make any material changes to these Terms & Conditions or the Saorview Privacy Policy. Your continued use of the Saorview Mobile Application shall constitute acceptance of any such update.

8. Miscellaneous

If any part of these Terms & Conditions are found to be unfair or unenforceable under Irish law, that part shall be treated as deleted from the Terms & Conditions and the remaining terms shall continue to govern the relationship between Saorview and you. These Terms & Conditions are governed by Irish law and any dispute arising out of these Terms & Conditions shall be decided by the courts of Ireland.

Saorview ID Terms & Conditions

Saorview.ie is a website which provides information regarding the Saorview DTT platform, which is established, operated and maintained by Raidio Teilifís Éireann (“RTÉ”). Saorview.ie is a separate website to RTÉ’s other websites and the Saorview.ie data is held separately from all other RTÉ data.

In order to sign up to Saorview ID, please visit the Saorview website at saorview.ie and complete the required fields at a minimum. You must be at least 18 years old and a permanent resident in Ireland to sign-up for a Saorview ID.

You can update your information at any time (for example, if you move house). You can also delete your Saorview ID at any time if you decide you no longer want it.

When signing up to Saorview ID, you have the option to select whether you would like to hear more from Saorview. If you opt-in to hear more from Saorview, the information you will receive by email on an occasional basis will include news about new channel launches, new product releases, information about programmes and services on Saorview, and details of when software updates are available for Saorview Connect devices.  

You can opt-out at any time.

By signing up to Saorview ID, you will also be able to pair your Saorview ID with your Saorview Connect device in order to schedule and manage recordings remotely using the Saorview Mobile Application (please refer to the Saorview Mobile Application Terms & Conditions for further details such as which devices are compatible with this functionality and how to download the Saorview Mobile Application). This will be enabled with a software upgrade for Saorview Connect devices, due in mid-2018.

By pairing your Saorview ID with your Saorview Connect device, you may be downloading and uploading data which may contribute towards any data limit you may have as part of your internet contract with your provider. Please ensure you check any such limits with your provider. Saorview is not responsible for any charges you may incur from your internet provider for pairing and using your Saorview ID with your Saorview Connect device.

By signing up to Saorview ID, you accept these Terms and Conditions and the terms of the Saorview Privacy Policy and the RTÉ Cookie Policy.

RTÉ reserves the right to withdraw Saorview ID at any time without notice.

RTÉ will notify you if we update these Terms and Conditions or the Saorview Privacy Policy or the RTÉ Cookie Policy. By logging into Saorview ID following such a change to the Terms & Conditions or Saorview Privacy Policy, you confirm your acceptance of the change. You will be given the opportunity to unsubscribe at a later date if you so choose.
